Mr. Speaker:

    Your CONSUMER AND PUBLIC AFFAIRS COMMITTEE, to whom has been referred

HOUSE BILL 397

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. On page 1, line 13, after the first semicolon, insert "AMENDING THE REQUIREMENTS FOR TESTING THE BLOOD OR BREATH OF A PERSON SUSPECTED OF OPERATING A MOTOR VEHICLE WHILE UNDER THE INFLUENCE OF INTOXICATING LIQUOR OR DRUGS;".

     2. On page 3, between lines 5 and 6, insert:

          "A. It is unlawful for a person who is under the influence of intoxicating liquor to drive a vehicle within this state.".

     3. Reletter the succeeding subsections accordingly.

     4. On page 13, line 3, after "chemical", insert "blood or breath".,

and thence referred to the JUDICIARY COMMITTEE.
