Mr. Speaker:

    Your HEALTH AND HUMAN SERVICES COMMITTEE, to whom has been referred

HOUSE BILL 146

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. On page 4, line 4, strike "two hundred dollars ($200)" and insert in lieu thereof "five hundred dollars ($500)".

     2. On page 4, line 9, after "exploitation", insert a period and:

     "If a transfer of money or property valued in excess of five hundred dollars ($500) to a non-relative whom the vulnerable adult has known for less than two years and for which the vulnerable adult does not receive the substantially equivalent financial value in funds, goods or services has been approved by a person who has been given a financial power of attorney or who has been appointed a trustee or guardian by a court of competent jurisdiction, that approval creates the presumption that the transfer was not the result of financial exploitation".

     3. On page 4, lines 14 through 17, strike Subsection B in its entirety.

     4. Reletter the succeeding subsections accordingly.,

and thence referred to the JUDICIARY COMMITTEE.
