Mr. President:

    Your PUBLIC AFFAIRS COMMITTEE, to whom has been referred

HOUSE BILL 86, as amended

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. Strike House Judiciary Committee Amendments 2 and 3.

    2. Strike Item 6 of House Floor Amendment number 1. 

    3. Strike Items 2 and 3 of House Floor Amendment number 2.

    4. On page 4, lines 10 through 13, strike Subsection A in its entirety and insert in lieu thereof the following new Subsection A:

         "A. "eligible employee" means, except as provided pursuant to Section 8 of the Public Employee Caregiver Leave Act, an individual who is an officer or employee of the state or of a public school and who, in accordance with the policies of the state agency or public school employing the officer or employee, is eligible to accrue sick leave;".

    5. On page 4, line 18, after "agency", insert "or public school".

    6. On page 5, line 6, after "agency", insert "or public school".

    7. On page 5, line 11, after "agency", insert "or public school".

    8. On page 5, strike lines 13 through 25 in their entirety and on page 6, strike lines 1 through 3 in their entirety and insert in lieu thereof a new subsection to read:

         "B. A state agency or public school employing an eligible employee shall not discharge or threaten to discharge, demote, suspend or retaliate or discriminate in any manner, including using the employee's use of caregiver leave as a factor in the employee's performance evaluation, against an eligible employee because that employee requests or uses caregiver leave in accordance with the state agency's or public school's general sick leave policy, files a grievance for violation of the Public Employee Caregiver Leave Act, cooperates in an investigation or prosecution of an alleged violation of that act or opposes any policy or practice established pursuant to that act.".

    9. On page 6, line 5, after "agency", insert "or public school".

    10. On page 6, line 10, after "agency", insert "or public school".

    11. On page 6, line 12, after "director", insert "and public school administrator".,

and thence referred to the JUDICIARY COMMITTEE.
