AN ACT
RELATING TO THE STATE BUDGET; PROVIDING A BENCHMARK FOR GENERAL FUND SUPPORT FOR THE JUDICIARY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. [NEW MATERIAL] STATE BUDGET--GENERAL FUND SUPPORT FOR JUDICIARY--BENCHMARK.--
A. It is the intent of the legislature that the judiciary's unified budget be funded in such amounts that the courts and judicial agencies are able to carry out their constitutional and statutory powers and duties.
B. Appropriations to the judiciary shall be benchmarked at not less than three percent of the anticipated recurring general fund revenue available for appropriation for the next fiscal year, after setting aside any payments for interest, sinking fund and public debt paid from the general fund and earmarked revenue from land grant permanent funds income; state lands maintenance fund residuals; fines, forfeitures, escheats and land rentals; and the federal Mineral Leasing Act.
SECTION 2. APPLICABILITY.--The provisions of this act apply to fiscal year 2019 and succeeding fiscal years.
