AN ACT
MAKING AN APPROPRIATION TO THE OIL CONSERVATION DIVISION OF THE ENERGY, MINERALS AND NATURAL RESOURCES DEPARTMENT TO DEVELOP A REQUEST FOR PROPOSALS FOR DESIGN-BUILD SERVICES TO REMEDIATE THE CARLSBAD BRINE WELL CAVERN AND VICINITY AT U.S. ROUTES 285 AND 62 IN CARLSBAD; DECLARING AN EMERGENCY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. APPROPRIATION.--Five hundred thousand dollars ($500,000) is appropriated from the general fund to the oil conservation division of the energy, minerals and natural resources department for expenditure in fiscal years 2017 through 2019 to develop a design-build request for proposals for services to remediate the Carlsbad brine well cavern located at: Unit Letter M (SW/4 of the SW/4) in Section 17, Township 22 South, Range 27 East, NMPM; Eddy County, New Mexico. The division shall act pursuant to the advice of the Carlsbad brine well remediation advisory authority. Any unexpended or unencumbered balance remaining at the end of fiscal year 2019 shall revert to the general fund.
SECTION 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
