SENATE BILL 6
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 1, lines 11 and 12, strike "ACCELERATING THE PHASE OUT OF THE HOLD HARMLESS DISTRIBUTIONS" and insert in lieu thereof "REDUCING A DISTRIBUTION TO THE LEGISLATIVE RETIREMENT FUND".
2. On page 1, line 16, after the semicolon, strike the remainder of the line, strike lines 17 through 21 in their entirety and strike line 22 through the semicolon.
3. On page 2, line 2, after the semicolon, strike the remainder of the line, strike line 3 in its entirety, strike line 4 up to the semicolon and insert in lieu thereof "MAKING AN APPROPRIATION".
4. On pages 2 through 19, strike Sections 1 and 2 in their entirety and insert the lieu thereof the following section:
"SECTION 1. Section 7-1-6.43 NMSA 1978 (being Laws 2003, Chapter 86, Section 1) is amended to read:
"7-1-6.43. DISTRIBUTION TO LEGISLATIVE RETIREMENT FUND.--
A. A distribution pursuant to Section 7-1-6.1
NMSA 1978 shall be made to the legislative retirement fund in an amount equal to [two hundred thousand dollars ($200,000)] seventy-five thousand dollars ($75,000) or, if larger, one-twelfth of the amount necessary to pay out the retirement benefits due under state legislator member coverage plan 2 and Paragraph (2) of Subsection C of Section [10-11-42] 10-11-41 NMSA 1978 for the calendar year.
B. In December 2003 and in each December thereafter, the public employees retirement association, with the assistance of the legislative council service, shall determine the amount of those retirement benefits for the succeeding calendar year. If the monthly average exceeds [two hundred thousand dollars ($200,000)] seventy-five thousand dollars ($75,000), the association shall notify immediately the department of the average amount. That average amount shall be the amount distributed pursuant to Subsection A of this section as of the end of each month of the twelve consecutive months beginning with the December in which the determination was made."".
5. On pages 23 through 25, strike Sections 5 and 6 in their entirety.
6. On page 38, lines 17 and 18, strike the underscored language, and on line 18, strike ", the" and insert in lieu thereof "The".
7. On page 54, strike Section 10 in its entirety.
8. On page 54, between lines 14 and 15, insert the following section:
"SECTION 7. APPROPRIATION.--One million five hundred thousand dollars ($1,500,000) is appropriated from the general fund to the children, youth and families department for expenditure in fiscal year 2017 and subsequent fiscal years to support child abuse prevention. Any unexpended or unencumbered balance remaining at the end of a fiscal year shall not revert to the general fund.".
9. On page 54, line 16, strike the subsection designation "A.".
10. On page 54, line 16, strike "9" and insert in lieu thereof "6".
11. On page 54, strike lines 20 through 23 in their entirety.
12. On page 55, lines 1 and 2, strike "4, 7 and 8" and insert in lieu thereof "3 through 5".
13. On page 55, line 4, strike "4, 7 and 8" and insert in lieu thereof "3 through 5".
14. On page 55, strike lines 7 and 8 in their entirety.
15. Renumber sections to correspond to these amendments.
