AN ACT
RELATING TO WATER; REQUIRING THE INTERSTATE STREAM COMMISSION TO FULLY FUND THE GRANT COUNTY REGIONAL WATER SUPPLY FROM THE NEW MEXICO UNIT FUND.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. NEW MEXICO UNIT FUND--MINIMUM ALLOCATION--REGIONAL WATER SUPPLY PROJECT FULLY FUNDED.--
A. The interstate stream commission shall allocate thirteen million dollars ($13,000,000) of the total amount distributed to the New Mexico unit fund pursuant to Paragraph (2)(D)(i) of Section 403(f) of the federal Colorado River Basin Project Act of 1968, as amended by Section 107(a) of the federal Arizona Water Settlements Act, Public Law 108-451, December 10, 2004, to fully implement the Grant county regional water supply project to meet water supply demands in Silver City and the mining district communities of Hurley, North Hurley, Bayard, Hanover and Santa Clara located in the southwest water planning region of New Mexico. The interstate stream commission shall pay from the New Mexico unit fund the costs to fully implement the Grant county regional water supply project in the southwest water planning region of New Mexico in accordance with the provisions of this section.
B. The interstate stream commission and Grant county shall provide quarterly status reports on the progress of the project to the appropriate legislative committees.
