AN ACT

RELATING TO PUBLIC ASSISTANCE; ENACTING A NEW SECTION OF THE PUBLIC ASSISTANCE ACT TO ESTABLISH PARITY IN ELIGIBILITY FOR MEDICAID FAMILY PLANNING SERVICES COVERAGE AND PREGNANCY SERVICES COVERAGE.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Public Assistance Act is enacted to read:

     "[NEW MATERIAL] MEDICAID--ELIGIBILITY FOR FAMILY PLANNING SERVICES.--The secretary shall adopt and promulgate rules, in accordance with federal law, to ensure that medicaid family planning services coverage is provided to applicants and reapplicants who:

          A. are eligible on the basis of household income as determined in accordance with the same financial eligibility criteria as those eligibility criteria promulgated for medicaid pregnancy services coverage;

          B. are otherwise eligible for medicaid family planning services coverage in accordance with federal law; and

          C. comply with procedures for applying and maintaining eligibility in accordance with department rules."
