Your RULES COMMITTEE, to whom has been referred
SENATE JOINT RESOLUTION 7
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 1, lines 11 and 12, strike "OR DONATION".
2. On page 1, line 18, strike "disposal" and insert in lieu thereof "disposition".
3. On page 1, line 21, strike "disposal" and insert in lieu thereof "disposition".
4. On page 2, line 10, after "legislature", insert "pursuant to the New Mexico School for the Arts Act".
5. On page 2, line 12, after "property", strike the remainder of the line.
6. On page 2, strike lines 18 through 22 in their entirety and insert in lieu thereof:
"WHEREAS, the New Mexico school for the arts presented a proposal to the capitol buildings planning commission at its meeting on October 22, 2014 for the transfer of the property to the school; the secretary of general services indicated, under the state's master plan, that no current use for the property was identified; and a number of members of the commission indicated their support for the transfer;".
7. On page 2, line 25, after "of", insert "all or a portion of".
8. On page 3, strike lines 20 through 25 in their entirety and insert in lieu thereof:
"BE IT FURTHER RESOLVED that the general services department shall transfer the property to the New Mexico school for the arts pursuant to the terms of a written agreement made by and between the general services department and the New Mexico school for the arts that provides that:
A. under the terms of the negotiated sale, the price for the property shall be the current appraised value plus whatever closing and other necessary costs are incurred for this transfer;
B. the New Mexico school for the arts shall grant, if necessary, an access easement to the general services department; and
C. if, notwithstanding the provisions of Subsection N of Section 22-8B-4 NMSA 1978, the New Mexico school for the arts terminates, has its charter terminated or is dissolved, and there is no statutorily authorized successor school, the property shall revert to the state under the management and control of the general services department or its successor agency; and".,
and thence referred to the FINANCE COMMITTEE.
