A JOINT RESOLUTION
PROPOSING AN AMENDMENT TO ARTICLE 8 OF THE CONSTITUTION OF NEW MEXICO TO RESTRICT THE USE OF MONEY DERIVED FROM TAXES, EXCISES, SURCHARGES AND FEES ON MOTOR VEHICLE FUELS AND ON THE PURCHASE, REGISTRATION AND USE OF MOTOR VEHICLES TO THE PLANNING, CONSTRUCTION, MAINTENANCE AND IMPROVEMENT OF TRANSPORTATION PROJECTS AND PROGRAMS, PAYMENT OF BOND DEBT FROM TRANSPORTATION PROJECTS AND OTHER PURPOSES AT THE TAX OR FEE AMOUNTS THAT ARE PROVIDED FOR BY LAW IN EFFECT ON THE DATE OF THE ADOPTION OF THE AMENDMENT.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. It is proposed to amend Article 8 of the constitution of New Mexico by adding a new section to read:
"Money derived from taxes, excises, surcharges and fees imposed by the state on motor vehicle fuels and on the purchase, registration and use of motor vehicles on public highways shall only be appropriated to administer the laws imposing those taxes, excises, surcharges and fees; for the payment of debt acquired from the issuance of bonds for transportation projects; to meet federal allotments under federal-aid road laws; for the planning, construction, maintenance and improvement of transportation projects; and for other purposes at the rate of tax or excise or the amount of surcharge or fee that are provided for by law in effect on the date of adoption of this amendment."
SECTION 2. The amendment proposed by this resolution shall be submitted to the people for their approval or rejection at the next general election or at any special election prior to that date that may be called for that purpose.
