AN ACT

RELATING TO BAIL; PROHIBITING THE AUTHORIZATION OF RELEASE ON PERSONAL RECOGNIZANCE BY A DESIGNEE OF THE COURT IN THE CASE OF AGGRAVATED BATTERY AGAINST A HOUSEHOLD MEMBER AND AGGRAVATED DRIVING UNDER THE INFLUENCE OF INTOXICATING LIQUOR OR DRUGS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 31-3-1 NMSA 1978 (being Laws 1972, Chapter 71, Section 8) is amended to read:

     "31-3-1. DESIGNEE TO ACCEPT BAIL.--Any statutory provision or rule of court governing the release of an accused may be carried out by a responsible person designated by the court, except that a designated person at a detention center shall not authorize release on personal recognizance for a defendant charged with:

          A. aggravated battery against a household member, pursuant to Section 30-3-16 NMSA 1978; or

          B. aggravated driving under the influence of intoxicating liquor or drugs, pursuant to Section 66-8-102 NMSA 1978."

     SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2015.
