AN ACT

RELATING TO SECURITIES; AMENDING THE NEW MEXICO UNIFORM SECURITIES ACT; PROHIBITING FALSE STATEMENT.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 58-13C-101 NMSA 1978 (being Laws 2009, Chapter 82, Section 101) is amended to read:

     "58-13C-101. SHORT TITLE.--[Sections 101 through 701 of this act] Chapter 58, Article 13C NMSA 1978 may be cited as the "New Mexico Uniform Securities Act"."

     SECTION 2. A new section of the New Mexico Uniform Securities Act is enacted to read:

     "[NEW MATERIAL] FALSE STATEMENT TO LAW ENFORCEMENT OFFICER.--It is unlawful for any person, in any matter within the jurisdiction of the director, to intentionally make any materially false, fictitious or fraudulent statement or representation to law enforcement officers of the division. A statement is material if it has a natural tendency to influence, or is capable of influencing, a decision of the director."
