Mr. President:

    Your CORPORATIONS AND TRANSPORTATION COMMITTEE, to whom has been referred

SENATE BILL 69

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. On page 3, line 1, strike "and".

    2. On page 3, strike lines 3 through 5 and insert in lieu thereof:

             "(1) a contract for items of tangible personal property, equipment, construction, services or professional services that is designated as a contract with respect to which bids or proposals are solicited only from a".

    3. On page 3, line 8, after "bids", insert "or proposals".

    4. On page 3, line 9, strike "invited" and insert in lieu thereof "solicited" and strike the period and insert "; and".

    5. On page 3, between lines 9 and 10, insert a new subsection:

         "I. "tangible personal property" means tangible property other than real property that has a physical existence, including supplies, equipment, materials and printed materials.".

    6. On page 3, lines 20 and 21, strike "for goods, equipment, construction or services".

    7. On page 3, line 23, after "bids", insert "or proposals".

    8. On page 3, line 25, strike "goods" and insert in lieu thereof "items of tangible personal property".

    9. On page 4, strike line 1 and insert in lieu thereof "equipment, construction, services or professional services at a fair and reasonable".

    10. On page 4, line 9, strike "seven" and insert in lieu thereof "twenty-one", and after "days", insert:

"of receipt of written notice of the disagreement. The non-prevailing party, as between the department and a contracting agency, shall pay all fees charged by the state auditor to resolve the dispute".

    11. On page 9, line 4, strike "a bid on".,

and thence referred to the JUDICIARY COMMITTEE.
