AN ACT
RELATING TO ELECTRIC UTILITIES; ENACTING A NEW SECTION OF THE RURAL ELECTRIC COOPERATIVE ACT TO PROVIDE FOR ELECTRIC COOPERATIVES' DISTRIBUTION LINES THROUGH TRIBAL LANDS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. A new section of the Rural Electric Cooperative Act is enacted to read:
"[NEW MATERIAL] OBLIGATION TO PROVIDE SERVICE ON TRIBAL LANDS.--A cooperative is not obligated to provide retail utility service to persons located on lands not subject to the public regulation commission's jurisdiction, including lands under the jurisdiction or control of a tribe. A cooperative shall provide retail utility service on lands subject to the jurisdiction or control of a tribe if the tribal government agrees that the provision of the service will be according to the same policies, terms and conditions that are applicable to the cooperative's other members. As used in this section, "tribe" means an Indian nation, tribe or pueblo located in whole or in part within the state."
