AN ACT

RELATING TO PETITIONS; REQUIRING NOMINATING PETITIONS AND OTHER ELECTION-RELATED PETITIONS TO INCLUDE THE NAME, ADDRESS AND SIGNATURE OF THE CIRCULATOR AND A DECLARATION BY THE CIRCULATOR.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Election Code is enacted to read:

     "[NEW MATERIAL] NOMINATING PETITIONS--OTHER ELECTION-RELATED PETITIONS--CIRCULATOR REQUIREMENTS.--

          A. Wherever any nominating petition or other election-related petition is filed with the proper filing officer, each page of the petition shall have a declaration signed by the circulator of the petition setting forth, in the circulator's own hand, the following:

                (1) the printed name of the circulator; and

                (2) the residence address of the circulator, giving street and number, or if no street or number exists, adequate designation of residence so that the location may be readily ascertained.

          B. Each petition shall also have a declaration that shall set forth the following:

                (1) that the circulator circulated that petition; and

                (2) that according to the best information and belief of the circulator, each signature is the genuine signature of the person whose name it purports to be.

          C. The circulator shall certify the content of the declaration as to its truth and correctness, under penalty of perjury under the laws of the state, with the circulator's signature and the date of signing.

          D. The provisions of this section apply to all state, county, municipal and special district elections for which a petition is required to be submitted by candidates in the election process or for which a petition is required to call the election."
