Mr. President:


    Your PUBLIC AFFAIRS COMMITTEE, to whom has been referred


HOUSE BILL 222, as amended


has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:


    1. Strike House Judiciary Committee Amendments 1, 2, 3, 4, 8,

9, 11, 12, 13, 14 and 15.


    2. On page 1, line 11, strike "TEAMS" and insert in lieu thereof "TEAM PILOT PROJECTS".


    3. On page 1, line 15, after "FOR", strike the remainder of the line, strike lines 16 and 17 in their entirety and insert in lieu thereof "APPROVAL OF COMMUNITY ENGAGEMENT TEAM PILOT PROJECTS.".


    4. On page 2, line 14, before "means", insert "or "community support worker"".


    5. On page 2, between lines 16 and 17, insert the following new subsection:


         "B. "certified peer support worker" means a person who:


             (1) is eighteen years of age or older;


             (2) has a high school diploma or high school equivalency credential;


             (3) is self-identified as a current or former consumer of mental health or substance abuse services;


             (4) has at least two years of mental health or substance abuse recovery; and


             (5) is certified by the state as a peer support worker;".

 

    6. Reletter the succeeding subsections accordingly.


    7. On page 3, lines 8 through 12, strike Subsections F and G in their entirety.


    8. Reletter the succeeding subsections accordingly.


    9. On page 4, line 22, strike "peers" and insert in lieu thereof "certified peer support workers".


    10. On page 4, line 25, strike "given to" and insert in lieu thereof "approved by".


    11. On page 5, line 1, after "one", insert "certified".


    12. On page 5, line 2, after "peer", strike "who lives with a mental disorder or illness" and insert in lieu thereof "support worker".


    13. On page 5, line 23 through page 6, line 16, strike Section 6 in its entirety and insert in lieu thereof:


    "SECTION 6. [NEW MATERIAL] DIVISION POWERS AND DUTIES.--


         A. The division may approve pilot projects of community engagement teams to work with persons who are unlikely to live safely in the community.


         B. By March 1, 2016, the division shall adopt rules to administer and implement the provisions of the Community Engagement Team Act, including:

 

             (1) procedures and forms to apply for approval to operate a community engagement team pilot project;


             (2) eligibility requirements for approval to operate a community engagement team pilot project;


             (3) documentation required to be provided by an applicant to demonstrate that it meets the eligibility requirements to operate a community engagement team pilot project;


             (4) procedures for the division's review, evaluation and approval of applications; and


             (5) criteria to evaluate the competence and ability of an applicant to fund and operate a community engagement team pilot project.

 

         C. The division, in consultation with the collaborative, shall adopt metrics to evaluate the effectiveness of community engagement team pilot projects and shall require approved community engagement team pilot projects to report such data as are necessary to measure the effectiveness of community engagement teams in reducing involuntary admissions for evaluation or treatment, intervention by law enforcement and detention in correctional facilities. The division shall develop such metrics in consultation with an advisory committee whose membership shall include a person living with a mental disorder or illness, a family member of a person living with a mental disorder or illness and a representative of each of the following:


             (1) the administrative office of the courts;


             (2) a state or local law enforcement agency that has a crisis intervention team;


             (3) a state educational institution named in Article 12, Section 11 of the constitution of New Mexico;


             (4) a class A county;


             (5) a class B county with a population over fifty thousand according to the most recent federal decennial census;


             (6) a class B county with a population under fifty thousand according to the most recent federal decennial census; and

 

             (7) such other interested parties as the division deems appropriate.


         D. No later than April 1, 2016, the division shall begin accepting applications for community engagement team pilot projects.

         E. The division shall have thirty days from the date of receipt of an application requesting approval of a community engagement team pilot project to complete its review of the application and issue a decision on the application. An applicant that is denied approval to operate a community engagement team pilot project may submit a new application sixty days or more after the division's decision.


         F. The division shall report annually to the interim legislative health and human services committee, the legislative finance committee and the appropriate interim committee that studies courts and corrections on the community engagement team pilot projects, with such report to include at a minimum:


             (1) statistics on the number of applications for pilot projects and the division's disposition of such applications;


             (2) data reported to the division by each approved pilot project;


             (3) analysis of data reported to the division by each approved pilot project; and

 

             (4) recommendations or findings, if any, relating to the community engagement team pilot projects.


         G. Upon approval of a community engagement team pilot project, the division shall provide contact information for the approved pilot project to the state crisis and access line contractor and direct the state crisis and access line contractor to refer non-emergent callers to such approved pilot project when such referral is deemed appropriate by the state crisis and access line contractor.


         H. The division shall make a directory, including contact and such other information as the division deems appropriate, of approved community engagement team pilot projects available to the public online and update such directory within fourteen days of its approval of a pilot project.".


    14. On page 6, line 22 through page 9, line 21, strike Section 8 in its entirety and insert in lieu thereof:


    "SECTION 8. [NEW MATERIAL] COMMUNITY ENGAGEMENT TEAM PILOT PROJECTS.--


         A. A community engagement team pilot project may be funded through appropriations from state or local governments, gifts, grants or donations.


         B. An application for approval to operate a community engagement team pilot project shall identify committed sources of funding sufficient to support operating costs of the pilot project for that portion of the current fiscal year remaining, if any, and the next fiscal year.".,
