AN ACT
RELATING TO PUBLIC ASSISTANCE; ENACTING A NEW SECTION OF THE PUBLIC ASSISTANCE ACT TO REQUIRE MEDICAL ASSISTANCE REIMBURSEMENT FOR CRISIS TRIAGE CENTER SERVICES AT A RATE IN PARITY WITH THE SAME HOSPITAL SERVICES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. A new section of the Public Assistance Act is enacted to read:
"[NEW MATERIAL] CRISIS TRIAGE CENTER--MEDICAL ASSISTANCE REIMBURSEMENT.--
A. In accordance with federal law, the secretary shall adopt and promulgate rules to establish a reimbursement rate for services provided to recipients of state medical assistance at a crisis triage center that, at a minimum, equals the medical assistance reimbursement rate for the same services provided at a hospital.
B. As used in this section:
(1) "crisis triage center" means a facility that provides emergency mental health evaluation and services to individuals detained pursuant to Section 43-1-10 NMSA 1978; and
(2) "hospital" means a health care facility that the department of health licenses as a hospital."
