FIFTY-SECOND LEGISLATURE

Mr. Speaker:

    Your SAFETY AND CIVIL AFFAIRS COMMITTEE, to whom has been referred

HOUSE BILL 30

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. On page 1, line 14, after "REQUIRING", insert "DRIVER'S LICENSES," and on line 15, strike "CERTAIN".

     2. On page 1, line 16, before the period, insert "; ENACTING A NEW SECTION OF THE LIQUOR CONTROL ACT TO PROTECT A PERSON WHO SELLS, SERVES OR GIVES ALCOHOL TO CERTAIN PERSONS". 

     3. On page 1, between lines 18 and 19, insert the following new sections:

     "SECTION 1. A new section of the Motor Vehicle Code is enacted to read:

     "[NEW MATERIAL] VERTICAL LICENSES.--An instruction permit, provisional license or driver's license issued to a person under the age of twenty-one years shall:

          A. have a printed legend indicating the person is under twenty-one;

          B. have a printed legend, displayed in such a manner as to be easily read by any person inspecting the license, indicating that the person is prohibited from purchasing alcoholic beverages; and

          C. be printed vertically."

     SECTION 2. A new section of the Ignition Interlock Licensing Act is enacted to read:

     "[NEW MATERIAL] CONTENTS.--An ignition interlock license issued to a person shall be printed vertically and have a printed legend, displayed in such a manner as to be easily read by any person inspecting the license, indicating that the person is prohibited from purchasing alcoholic beverages."".

     4. Renumber the succeeding sections accordingly.

     5. On page 2, line 11, strike "of" and insert in lieu thereof "issued to".

     6. On page 2, line 14, strike "of" and insert in lieu thereof "issued to".

     7. On page 2, line 20, after "beverages", insert a period, strike the remainder of the line and strike lines 21 and 22 in their entirety.

     8. On page 2, between lines 22 and 23, insert the following new subsection:

          "D. An identification card issued pursuant to Subsection B or C of this section shall be clearly marked and printed vertically."".

     9. On page 4, lines 1 through 6, strike Subsection C in its entirety.

     10. Reletter the succeeding subsections accordingly.

     11. On page 4, line 11, after "beverages", insert a period, strike the remainder of the line and strike lines 12 and 13 in their entirety.

     12. On page 12, line 8, strike "court or the division may prohibit a".

     13. On page 12, line 9, after "device", insert "is prohibited".

     14. On page 14, between lines 22 and 23, insert the following new section:

     "SECTION 4. A new section of the Liquor Control Act is enacted to read:

     "[NEW MATERIAL] SELLING OR SERVING ALCOHOL TO CERTAIN PERSONS.--It is not a violation of the Liquor Control Act for a person, including a person licensed pursuant to the provisions of the Liquor Control Act, or an employee, agent or lessee of that person, to sell, serve or give alcoholic beverages to a person, other than a minor, who has been issued an ignition interlock license or identification card bearing a printed legend indicating that the person is prohibited from purchasing alcoholic beverages."".

     15. Renumber the succeeding section accordingly.,
