AN ACT
RELATING TO WATER; PROHIBITING THE INTERSTATE STREAM COMMISSION FROM NOTIFYING THE SECRETARY OF THE INTERIOR OF ITS INTENT TO CONSTRUCT A NEW MEXICO UNIT UNTIL FUNDING HAS BEEN SECURED TO COMPLETE THE PROJECT.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. [NEW MATERIAL] NEW MEXICO UNIT AUTHORIZATION.--
A. Neither the interstate stream commission nor any other agent of the state of New Mexico shall give written notice to the secretary of the federal department of the interior that the state intends to build the New Mexico unit until all funding necessary for completion of the New Mexico unit has been secured and guaranteed by the beneficiaries of the project.
B. For the purposes of this section, "New Mexico unit" is that unit of the central Arizona project authorized by Sections 301(a)(4) and 304 of the federal Colorado River Basin Project Act, as amended by Section 212 of the federal Arizona Water Settlements Act, Public Law 108-451, December 10, 2004.
