Mr. Speaker:
Your HEALTH, GOVERNMENT & INDIAN AFFAIRS COMMITTEE, to whom has been referred
HOUSE BILL 342
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 1, line 24, after "to", insert a colon.
2. On page 1, line 24, strike "child" and the remainder of the line and strike line 25 in its entirety, and on page 2, strike lines 1 through 11 in their entirety and insert in lieu thereof the following new subparagraphs:
"(a) child care centers;
(b) residential treatment centers that serve persons up to twenty-one years of age;
(c) community mental health centers that serve only persons up to twenty-one years of age;
(d) day treatment centers that serve persons up to twenty-one years of age;
(e) shelter care homes;
(f) those outpatient facilities that are also community-based behavioral health facilities serving only persons up to twenty-one years of age; and
(g) wilderness youth programs; or".
3. On page 3, line 7, strike "any other" and strike lines 8 through 11 in their entirety, and on line 12, strike "a twelve-month period" and insert in lieu thereof "a wilderness youth program".
4. On page 3, line 21, strike the second instance of "and".
5. On page 4, line 6, strike "any other program," and strike lines 7 through 10 in their entirety, and on line 11 strike "month period" and insert in lieu thereof "wilderness youth programs".
6. On page 4, line 13, strike the period and closing quotation marks and insert in lieu thereof "; and".
7. On page 4, between lines 13 and 14, insert the following new subsection:
"F. "wilderness youth program":
(1) means a business or organization that provides residence to and accepts custody, care or control, including temporary guardianship, of a child for the purposes of behavior modification, and that:
(a) charges a fee or accepts donations or scholarships for its services;
(b) may limit or censor all communications between a child and the child's parent or guardian; and
(c) restricts a child's ability to leave the program by the child's choice; and
(2) does not include:
(a) seasonal programs with a primary purpose of recreation;
(b) programs that are approved by the department and that have national accreditation that ensures the health, safety or welfare of children;
(c) programs that are otherwise governed by specific state law; or
(d) programs that are defined by the constitution of New Mexico as state educational institutions."".
