AN ACT
RELATING TO ELECTED OFFICIALS; PROVIDING COMPENSATION INCREASES FOR ELECTED OFFICERS FOR NEW TERMS BEGINNING ON OR AFTER JANUARY 1, 2015; MAKING AN APPROPRIATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. Section 8-1-1 NMSA 1978 (being Laws 1971, Chapter 260, Section 1, as amended) is amended to read:
"8-1-1. COMPENSATION OF ELECTIVE STATE OFFICERS.--
A. Annual compensation of elective state officers shall be paid as follows:
governor. . . . . . . . . . . . . . .[$110,000] $121,000
secretary of state. . . . . . . . . . . . [85,000] 93,500
state auditor. . . . . . . . . . . . . . .[85,000] 93,500
state treasurer. . . . . . . . . . . . . [85,000] 93,500

commissioner of public lands. . . . . . . [90,000] 99,000

B. Any person succeeding to the office of governor as provided in Article 5, Section 7 of the constitution of New Mexico shall receive the salary of the office. Every person serving as acting governor during the incapacity or absence of the governor from the state, other than the secretary of state, shall receive two hundred fifty dollars ($250) as compensation for each day's service as acting governor.
C. All compensation under this section shall be paid from the general fund, except that the amount paid to the commissioner of public lands shall be paid from the state lands maintenance fund."
SECTION 2. Section 8-3-3 NMSA 1978 (being Laws 1971, Chapter 138, Section 3, as amended) is amended to read:
"8-3-3. COMPENSATION.--For the performance of the duties established in Section 8-3-1 NMSA 1978, the lieutenant governor shall receive an annual compensation of [eighty-five thousand dollars ($85,000)] ninety-three thousand five hundred dollars ($93,500)."
SECTION 3. APPROPRIATION.--
A. The following appropriations for the following purposes are made for executive branch state elected officials whose terms begin on or after January 1, 2015:
(1) sixty-three thousand three dollars ($67,003) is appropriated from the general fund to the department of finance and administration for expenditure in fiscal year 2015 to provide executive branch elective state officers, including the lieutenant governor but not including the commissioner of public lands, with a ten percent compensation increase; and
(2) five thousand six hundred ninety-nine dollars ($5,699) is appropriated from the state lands maintenance fund to the state land office for expenditure in fiscal year 2015 to provide the commissioner of public lands with a ten percent compensation increase.
B. Any unexpended or unencumbered balance remaining at the end of fiscal year 2015 shall revert to the originating fund.
SECTION 4. APPLICABILITY.--The compensation increases provided in this act apply to new terms beginning on or after January 1, 2015.
