    Your JUDICIARY COMMITTEE, to whom has been referred

HOUSE BILL 10

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. On page 3, between lines 12 and 13, insert the following new subsection:

          "D. A prior conviction for driving under the influence of intoxicating liquor or drugs pursuant to Section 66-8-102 NMSA 1978 that is used to enhance the punishment for driving under the influence of intoxicating liquor or drugs shall also be used as the basis for enhancement of the offender's sentence pursuant to this section.".

     2. Reletter the succeeding subsections accordingly.
