AN ACT

RELATING TO POLICE SHOOTINGS; REQUIRING AN OFFICER INVOLVED IN A POLICE SHOOTING TO HAVE A PUBLIC PRELIMINARY HEARING.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of Chapter 31 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] POLICE SHOOTINGS--PRELIMINARY HEARING REQUIRED.--If a peace officer discharges a firearm resulting in death while carrying out the duties of the officer's office or employment, the prosecuting attorney shall present evidence in a preliminary hearing before the district court in whose jurisdiction the incident occurred."

     SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2013.
