AN ACT
RELATING TO LIBRARIES; CREATING THE LIBRARY ACQUISITIONS FUND; CREATING THE LIBRARY ACQUISITIONS TASK FORCE; MAKING AN APPROPRIATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. A new section of the Cultural Affairs Department Act is enacted to read:
"[NEW MATERIAL] LIBRARY ACQUISITIONS FUND--CREATED--ADMINISTRATION--LIBRARY ACQUISITIONS TASK FORCE--CREATED.--
A. The "library acquisitions fund" is created as a nonreverting fund in the state treasury. The fund consists of appropriations, income from investment of the fund, gifts, grants, donations and bequests. The fund shall be administered by the library division of the cultural affairs department based on the recommendations of the library acquisitions task force, and money in the fund is subject to appropriation by the legislature to carry out the provisions of this section. Disbursements from the fund shall be by warrant of the secretary of finance and administration pursuant to vouchers signed by the director of the library division of the cultural affairs department or the director's authorized representative.
B. Money in the library acquisitions fund shall be used for the acquisition of library resources, including library processing services, inter-library resource-sharing services, library materials, including print, non-print and electronic materials, equipment, bookmobiles, computer hardware and software, furniture required to display and house library materials and electronic library subscriptions.
C. The "library acquisitions task force" is created to develop guidelines, make recommendations and establish allocation formulas in connection with the library acquisitions fund. The library acquisitions task force shall include the state librarian and one representative from each of the following libraries, to be appointed by the governor:
(1) a public school library;
(2) an institution of higher education library;
(3) a public library; and
(4) a tribal library."
SECTION 2. APPROPRIATION.--Five million dollars ($5,000,000) is appropriated from the general fund to the library acquisitions fund for expenditure in fiscal year 2014 and subsequent fiscal years to support the acquisitions and operations of public libraries, college and university libraries, tribal libraries, the state library and public school libraries. Any unexpended or unencumbered balance remaining at the end of a fiscal year shall not revert to the general fund.
