AN ACT
RELATING TO HEALTH INSURANCE; REQUIRING MEDICAID ENROLLMENT REFERRAL BY PUBLIC SCHOOLS AND LICENSED CHILD CARE PROVIDERS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. A new section of the Public School Code is enacted to read:
"[NEW MATERIAL] PUBLIC SCHOOLS--ENROLLMENT REQUIREMENTS--MEDICAID APPLICATION.--
A. The secretary shall, after consultation with the human services department, establish rules:
(1) that require students to furnish proof of health insurance coverage prior to school enrollment. Students not furnishing proof of health insurance coverage shall be referred to a person authorized to complete a medicaid application on the student's behalf; and
(2) that provide for the automatic referral of any student enrolled in a federal school nutritional program to a person authorized to complete a medicaid application on the student's behalf and the forwarding of that application to the human services department.
B. Students referred for medicaid application pursuant to Subsection A of this section shall be provided with human services department information on presumptive eligibility for medicaid and the state children's health insurance program."
SECTION 2. [NEW MATERIAL] CHILD CARE FACILITIES--ENROLLMENT REQUIREMENTS--MEDICAID APPLICATION.--The children, youth and families department shall, after consultation with the human services department, establish rules requiring licensed child care facilities to require proof of health insurance coverage of each child prior to enrollment at the facility. Families not furnishing proof of health insurance coverage shall complete an application for state medicaid eligibility that shall be referred to a person authorized to complete a medicaid application on the child's behalf. Families without proof of health insurance shall be furnished with human services department information on presumptive eligibility for medicaid and the state children's health insurance program.
