AN ACT

RELATING TO TAXATION; PROVIDING FOR THE COLLECTION OF PROPERTY TAXES ON REAL PROPERTY DIVIDED OR COMBINED; DECLARING AN EMERGENCY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Property Tax Code is enacted to read:

     "[NEW MATERIAL] SPECIAL PROCEDURES FOR ADMINISTRATION OF TAXES ON REAL PROPERTY WHEN DIVISION OF PROPERTY WILL JEOPARDIZE COLLECTION OF TAXES.--If the county treasurer or assessor has reasonable cause to believe that real property subject to valuation for property taxation purposes in a tax year will be divided or combined and that the division or combination of that property will impede the ability to maintain current property tax assessments and will jeopardize the collection of the tax on that property, the county treasurer or assessor may:

          A. proceed immediately to determine the value of the property and provide a notice of valuation to the property owner;

          B. proceed to determine the taxes due on the property that has been divided or combined and proceed to immediately collect the taxes through the taxable year in which the property is divided or combined; and

           C. decline to process a plat pending taxpayer compliance with this section."

     SECTION 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
