Mr. Speaker:

 

    Your BUSINESS AND INDUSTRY COMMITTEE, to whom has been referred

 

SENATE BILL 128, as amended

 

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

 

1. Strike Senate Judiciary Committee Amendment 11.

 

     2. On page 3, between lines 9 and 10, insert the following:

 

          "D. that requires a fiduciary responsibility to the employer, including the authority to issue payments, collect debts, transfer money or enter into contracts.

 

     SECTION 5. REMEDY.--A person who claims to be harmed by a

violation of the Prospective Employee Credit Information Privacy Act

may bring a civil action in a court of competent jurisdiction to

obtain injunctive relief or damages or both.".

 

     3. Renumber the succeeding section accordingly.,

 

and thence referred to the JUDICIARY COMMITTEE.
