 SENATE BILL 113 AND AND SENATE EDUCTION

 COMMITTEE SUBSTITUTE FOR SENATE BILL 392

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. On page 1, line 13, strike "MAKING A".

     2. On page 1, strike lines 14 through 16 in their entirety, and strike line 17 through the semicolon and insert in lieu thereof "transferring funds from the general fund operating reserve to the tobacco settlement permanent fund;".

     3. On page 2, line 11, after "agreement", insert "or as otherwise authorized by law".

     4. On page 3, line 23, strike "Subsections" and insert in lieu thereof "Subsection", strike "and E" and strike "and in".

     5. On page 3, strike line 24 up to the comma.

     6. On page 3, line 25, before "to", insert "pursuant to the master settlement agreement".

     7. On page 4, strike Subsection E in its entirety.

     8. Reletter the remaining subsection accordingly.

     9. On pages 4 and 5, strike Section 2 in its entirety and insert in lieu thereof a new Section 2 as follows:

     "SECTION 2. TEMPORARY PROVISION--TRANSFER OF FUNDS.--On the effective date of this act, forty million dollars ($40,000,000) is transferred from the general fund operating reserve to the tobacco settlement permanent fund. This transfer represents a restoration of funds diverted from the tobacco settlement permanent fund to meet state fiscal solvency requirements.".
