AN ACT

RELATING TO PUBLIC EDUCATION; REQUIRING THE PUBLIC EDUCATION DEPARTMENT TO PROMULGATE RULES FOR HEALTHY AND NUTRITIONAL SCHOOL LUNCHES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 22-13-13 NMSA 1978 (being Laws 1967, Chapter 16, Section 187) is amended to read:

     "22-13-13. SCHOOL LUNCH PROGRAM.--

          A. The [state board] department shall prescribe standards and regulations for the establishment and operation of school lunch programs in the state. The department [of education] shall provide technical advice and assistance to any school district in connection with the establishment or operation of a school lunch program. The regulations shall provide:

                (1) minimum nutritional standards for all lunches served, including total caloric content standards, saturated and unsaturated fat standards, sodium standards, sugar standards, fiber standards and vitamin and mineral standards;

                (2) that New Mexico-grown fresh fruits and vegetables be included in all school lunch programs; and

                (3) that food served in school lunch programs be purchased from New Mexico vendors where feasible.

          B. A local school board may accept gifts or grants for use in connection with a school lunch program in the school district.

          C. A "school lunch program" means a program under which lunches are served by a public school in the state on a nonprofit basis to students attending the school."
