AN ACT

RELATING TO CULTURE; CREATING A MUSIC COMMISSION STAFF POSITION; ESTABLISHING POSITION DUTIES; MAKING AN APPROPRIATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 18-16-1 NMSA 1978 (being Laws 2009, Chapter 13, Section 1) is amended to read:

     "18-16-1. SHORT TITLE.--[This act] Chapter 18, Article 16 NMSA 1978 may be cited as the "Music Commission Act"."

     SECTION 2. A new section of the Music Commission Act is enacted to read:

     "[NEW MATERIAL] COMMISSION STAFF POSITION-- CREATED--DUTIES.--

          A. A member of the staff of the division shall be dedicated to overseeing programs of the commission.

          B. Subject to the policies agreed to by the commission, the member of the staff shall:

                (1) report to the director of the division;

                (2) oversee the commission in its performance of duties;

                (3) collaborate with other state agencies, including the New Mexico film division and other divisions of the economic development department, the tourism development division of the tourism department, the public education department and the cultural affairs department, to assist the commission in performing its duties;

                (4) advocate for the economic development of the state's music and music education industries; and

                (5) perform other duties as directed by the commission or as provided by law."

     SECTION 3. APPROPRIATION.--

          A. Eighty thousand dollars ($80,000) is appropriated from the general fund to the cultural affairs department for expenditure in fiscal year 2014 for the following purposes:

                (1) sixty thousand dollars ($60,000) for a music commission staff position; and

                (2) twenty thousand dollars ($20,000) for music commission programs, services or operations.

          B. Any unexpended or unencumbered balance remaining at the end of fiscal year 2014 shall revert to the general fund.
