AN ACT

RELATING TO VIOLENT FELONIES; REQUIRING A PRELIMINARY HEARING FOR VIOLENT FELONIES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of Chapter 31 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] VIOLENT FELONY--PRELIMINARY HEARING REQUIRED.--If the state believes there may be probable cause to charge a person with a violent felony, the prosecuting attorney shall present evidence in a preliminary hearing before the district court in whose jurisdiction the incident occurred."

     SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2013.
