AN ACT

RELATING TO PUBLIC SCHOOLS; PROVIDING A STIPEND FOR LOCAL SCHOOL BOARD MEMBERS ATTENDING SCHOOL BOARD MEETINGS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 22-5-5 NMSA 1978 (being Laws 1967, Chapter 16, Section 29) is amended to read:

     "22-5-5. COMPENSATION--PROHIBITED EMPLOYMENT.--

          A. At the first meeting of a local school board attended by newly elected or reelected members following a school board election, the local school board shall by majority vote determine the amount of a stipend, not to exceed seventy-five dollars ($75.00), to be received by a member of a local school board pursuant to this section. At the conclusion of a local school board meeting open to the public, each local school board member who attended the meeting in its entirety shall elect to receive or waive the receipt of the stipend. The absence of an election shall be construed as a waiver of the stipend. The cost of stipends pursuant to this section shall be paid from the operational fund of the school district. The members of a local school board shall [serve without] receive no other compensation, perquisite or allowance.

          B. No member of a local school board shall be employed in any capacity by a school district governed by that local school board during the term of office for which the member was elected or appointed."
