    Your AGRICULTURE AND WATER RESOURCES COMMITTEE, to whom has been referred

HOUSE BILL 397

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. On page 1, line 11, after the semicolon, strike the remainder of the line, strike line 12 up to the semicolon and insert in lieu thereof "PROHIBITING THE STATE ENGINEER FROM ACCEPTING FOR FILING INCOMPLETE APPLICATIONS".

     2. On page 1, line 24, after "water", insert ", or to change a valid existing water right pursuant to Section 72-5-23, 72-5-24 or 72-12-7 NMSA 1978,".

     3. On page 1, line 24, after "engineer", insert "for filing".

     4. On page 2, line 1, after "appropriation", insert "or change".

     5. On page 2, line 5, after "appropriation", insert "or to change a valid existing water right for more than one thousand acre- feet of water".

     6. On page 2, line 6, after "personally", insert "to determine if the application provides the specificity required by Subsection A of this section".

and thence referred to the JUDICIARY COMMITTEE.
