    Your JUDICIARY COMMITTEE, to whom has been referred


HOUSE JUDICIARY COMMITTEE SUBSTITUTE FOR

HOUSE BILL 304


has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:


    1. On page 1, line 19, after "jurisdiction", insert "against an alleged human trafficker".


    2. On page 4, line 18, strike "legal assistance" and insert in lieu thereof "advocacy services".


    3. On page 5, line 2, after "identification", insert "by law enforcement".


    4. On page 5, between lines 3 and 4, insert the following new subsection:


         "C. Before providing benefits and services pursuant to Subsection A of this section, law enforcement shall certify to the human services department and the children, youth and families department that a person is:


             (1) a victim of human trafficking; and


             (2) cooperating in the investigation or prosecution of the person charged with the crime of human trafficking.".


    5. Reletter the succeeding subsections accordingly.




    6. On page 5, line 6, after the period, insert:


    "The victim is not required to cooperate if the court determines that the victim is unable to cooperate due to physical or psychological trauma.".


    7. On page 6, line 12, strike "through a", strike line 13 in its entirety and strike line 14 up to the period.
