Your JUDICIARY COMMITTEE, to whom has been referred
HOUSE JUDICIARY COMMITTEE SUBSTITUTE FOR
HOUSE BILL 146, as amended
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 2, strike lines 23 through 25 in their entirety and on page 3, strike lines 1 through 5 in their entirety and insert in lieu thereof:
"E. Unless a retailer has violated any provision of this section in a wanton, reckless or deliberate manner, a retailer utilizing the real-time stop sale system in accordance with this section shall not be civilly liable as a result of any act or omission in carrying out the duties required by this section.".
2. On page 4, line 18, after "who", insert "knowingly or intentionally".
