Mr. President:
Your JUDICIARY COMMITTEE, to whom has been referred
SENATE BILL 235
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 9, strike line 13 in its entirety and insert in lieu thereof "be valid for a period of one year.".
2. On page 14, between lines 17 and 18, insert the following new subsection:
"A. The department shall identify any person who was issued an instruction permit, a driver's license or a provisional license prior to July 1, 2012 without the person providing the person's social security number and for whom the department has reasonable articulable suspicion that the person is no longer a resident of New Mexico. The department shall verify the residence address of all persons so identified via certified mail, return receipt requested. Notwithstanding the provisions of Subsections C and D of this section, the department shall cancel the instruction permit, driver's license or provisional license of any person for whom the residence address is not verified without further notice. A person whose instruction permit, driver's license or provisional license is canceled pursuant to this subsection may request, within twenty days of actual notice of cancellation, that the department rescind the order of cancellation and afford the person an opportunity to show proof of New Mexico residency pursuant to Section 66-5-9 NMSA 1978.".
3. Reletter the succeeding subsections accordingly.
4. On page 16, line 10, after "A", insert "or B".
