AN ACT

RELATING TO FINANCIAL SOLVENCY; PROVIDING FLEXIBILITY TO SCHOOL DISTRICTS DURING PERIOD OF DECREASED FUNDING; SUSPENDING THE REQUIREMENTS FOR CERTAIN STUDENT ASSESSMENTS IN THE 2012-2013 SCHOOL YEAR.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. PUBLIC SCHOOL FINANCIAL SOLVENCY--TEMPORARILY SUSPENDING CERTAIN STUDENT ASSESSMENTS.--

          A. The purpose of this section is to provide flexibility to school districts during this period of decreased funding by suspending the requirements that school districts administer certain student assessments.

          B. For the 2012-2013 school year, the public education department and school districts, charter schools and state educational institutions shall not be required to administer the following student assessments:

                (1) the provisions of Section 22-2C-4 NMSA 1978, notwithstanding the standards-based assessment in social studies in grade eleven; and

                (2) the provisions of Section 22-2C-4.1 NMSA 1978, notwithstanding a college placement assessment or a workforce readiness assessment in grade eleven.

          C. During the 2012-2013 school year, all public schools and state educational institutions shall use an appropriate assessment for grades nine and ten to comply with the federal Individuals with Disabilities Education Act.
