AN ACT
RELATING TO MOTOR VEHICLES; PROVIDING FOR SPECIAL PERMITS FOR HAY TRANSPORTATION; ELIMINATING DISTANCE LIMITS FOR HAY TRANSPORTATION; RECONCILING MULTIPLE AMENDMENTS TO THE SAME SECTION OF LAW IN LAWS 1995.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. Section 66-7-413.1 NMSA 1978 (being Laws 1985, Chapter 4, Section 1, as amended by Laws 1995, Chapter 28, Section 1 and also by Laws 1995, Chapter 135, Section 23) is amended to read:
"66-7-413.1. [FARM CARRIERS] HAY TRANSPORTATION--EXCESSIVE SIZE--[LIMITATION] SPECIAL PERMIT ALLOWANCE.--[Farm carriers, as defined in Sections 65-2-82 and 65-2-116 NMSA 1978, may transport loads up to twelve feet in width on highways that are not national network highways without securing permits or escorts only if the load consists of hay tied in bales over five feet in either length or width and the load is not transported for any distance greater than two hundred miles; provided that the farm carriers display a sign across the front and rear stating "WIDE LOAD" in large visible letters.] A vehicle used to transport loads of hay greater than one hundred two inches wide may be issued a special permit to transport loads pursuant to Section 66-7-413 NMSA 1978; provided that the vehicle is marked on the front and the rear with "OVERSIZED LOAD" signs. The area covered by the special permit shall be specified on the permit."
