Your LABOR AND HUMAN RESOURCES COMMITTEE, to whom has been referred
HOUSE BILL 181
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 2, line 2, after "check", insert "; costs assessed from an employee for a background check may be paid through a payroll deduction".
2. On page 2, between lines 13 and 14, insert the following new subsection:
"C. Institutions of higher education shall require background checks on employees who are currently employed with the institution when the employee applies to transfer positions, when the employee's position is reclassified or as a condition of promotion. The board of regents or governing body of each institution shall determine by rule which positions require a background check to be conducted on a current employee. The institution may require background checks on probationary employees. The background checks shall comport with Subsection B of this section.".
3. Reletter the succeeding subsection accordingly.
4. On page 2, line 19, strike the ending quotation mark.
5. On page 2, between lines 19 and 20, insert the following new subsections:
"E. The provisions of this section shall not apply to the following categories of employee:
(1) currently enrolled students who are working at an institution of higher education as part of a financial assistance program; and
(2) employees hired by the institution on a temporary or emergency basis for a defined limited term.
F. Background checks shall be conducted on the employees specified in Subsection E of this section before those employees can be granted a permanent position at the institution of higher education."".,
and thence referred to the EDUCATION COMMITTEE.
