Mr. Speaker:

    Your JUDICIARY COMMITTEE, to whom has been referred

HOUSE JOINT RESOLUTION 12

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. On page 1, line 12, after "RECALL", insert "AND REPLACEMENT".

     2. On page 2, strike lines 12 through 15 in their entirety and insert the following paragraph in lieu thereof:

                "(2) not fewer in number than:

                     (a) for an office subject to a statewide election, 20 percent of the number of persons who voted in the election for the office in the last preceding general election at which the office was voted upon; or

                     (b) for an office subject to a non-statewide election, 30 percent of the number of persons who voted in the election for the office in the last preceding general election at which the office was voted upon.".

     3. On page 3, line 1, strike "After", and insert in lieu thereof "Within one hundred twenty days after".

     4. On page 3, line 14, after "filled", strike the remainder of the line, strike line 15 up to the period and insert in lieu thereof "by special election to be called and held within ninety days of the creation of the vacancy".

     5. On page 3, line 22, strike the quotation mark.

     6. On page 3, between lines 22 and 23, insert the following new subsection:

          "F. Legislation to implement this section of Article 20 of the constitution of New Mexico shall specify rules of procedure for the proceedings before the state supreme court pursuant to Subsection C of this section."".,

and thence referred to the VOTERS AND ELECTIONS COMMITTEE.
