A MEMORIAL
REQUESTING THE OFFICE OF THE ATTORNEY GENERAL TO STUDY THE FEASIBILITY OF IMPLEMENTING A "COMMUNICATION PROTECTION REGISTRY ACT".
WHEREAS, the residents of New Mexico are subject to receiving inappropriate and unwanted messages through various forms of electronic messaging systems; and
WHEREAS, the message preference system is a program to protect residents from unwanted classes of electronic messages; and
WHEREAS, a message preference system could be implemented in New Mexico at no cost to the state; and
WHEREAS, residents could register, through an internet web site, their email addresses, mobile phone numbers, instant messenger identifications and other electronic contact points as being off limits to certain classes of electronic messages; and
WHEREAS, the registrants' information contained within a message preference system database would remain confidential, accessible only to authorized state agencies or third parties; and
WHEREAS, at no time would any third party be able to use information contained within a message preference system database to contact a registrant for any reason; and
WHEREAS, security systems would be able to eliminate abuse of a message preference system and ensure that the private information of registrants is kept confidential; and
WHEREAS, it would be unlawful for a person to promote to a registered electronic contact point the person's trade, business goods, products, property or services sold; and
WHEREAS, a person that violates a provision of the Communication Protection Registry Act could be assessed a civil or criminal penalty by the attorney general;
NOW, THEREFORE, BE IT RESOLVED BY THE SENATE OF THE STATE OF NEW MEXICO that the office of the attorney general be requested to study the feasibility of implementing in New Mexico a Communication Protection Registry Act; and
BE IT FURTHER RESOLVED that the office of the attorney general present the results of its study and any recommendations for legislation to the appropriate interim legislative committees by October 1, 2011; and
BE IT FURTHER RESOLVED that a copy of this memorial be transmitted to the office of the attorney general.
