AN ACT

RELATING TO SEX OFFENDERS; PROHIBITING LOCAL GOVERNMENTS FROM ADOPTING AN ORDINANCE, RULE OR OTHER LAW THAT IMPOSES RESIDENCY RESTRICTIONS ON SEX OFFENDERS OR THAT CREATES EXCLUSIONARY ZONES; ALLOWING RESIDENCY RESTRICTIONS AND EXCLUSIONARY ZONES IN APPROPRIATE CASES AS A CONDITION OF PROBATION OR PAROLE.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Sex Offender Registration and Notification Act is enacted to read:

     "[NEW MATERIAL] RESIDENCY RESTRICTIONS--EXCLUSIONARY ZONES.--

          A. A city, county, home rule municipality or other political subdivision of the state is prohibited from adopting or continuing in effect any ordinance, rule, regulation, resolution or other law that imposes distance restrictions for a registered sex offender's place of residence or that creates an exclusionary zone from which all registered sex offenders are excluded.

          B. Nothing in Subsection A of this section shall prohibit, in appropriate cases, the imposition of distance restrictions for a registered sex offender's place of residence or the creation of zones from which a registered sex offender is excluded as a condition of probation or parole supervision."

     SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2011.
