Your CORPORATIONS AND TRANSPORTATION COMMITTEE, to whom has been referred
SENATE BILL 122
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 1, lines 11 through 13, strike "PROVIDING AN EXCEPTION FOR FILING INDIVIDUAL CONTRACTS OR TARIFFS TO CERTAIN COMPETITIVE SERVICE PROVIDERS" and insert in lieu thereof "MODIFYING REQUIREMENTS FOR THE FILING OF TARIFFS CONCERNING BUSINESS SERVICES AND INDIVIDUAL CONTRACTS".
2. On page 2, line 22, through page 3, line 1, strike the underscored language.
3. On page 4, line 3, strike the closing quotation mark and between lines 3 and 4, insert the following subsection:
"E. Notwithstanding the provisions of this section, upon written notice to the commission, a provider of local exchange services or message telecommunications services may withdraw any tariffs concerning business services; provided, however, that the provider shall post the rates, terms and conditions on the provider's publicly accessible web site."".
4. On page 5, line 25, after the comma, insert "for those business services for which tariffs are withdrawn pursuant to this section, a provider of local exchange services or message telecommunications services shall not be required to apply for or file individual contracts or other evidence of the service to be provided."".
5. On page 6, lines 1 through 3, strike the underscored language in its entirety.,
and thence referred to the JUDICIARY COMMITTEE.
