Your HEALTH AND GOVERNMENT AFFAIRS COMMITTEE, to whom has been referred
HOUSE BILL 216
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 2, line 22, after "Act", insert "and except as provided in Subsection E of this section".
2. On page 3, line 3, after "involved", insert "and witnesses".
3. On page 3, line 6, after "involved", insert "and witnesses".
4. On page 3, line 8, strike the quotation marks.
5. On page 3, between lines 8 and 9, insert the following new subsection:
"E. An accident report may be provided without redaction to or inspected or copied without redaction by any of the following:
(1) a party involved in the accident;
(2) a legal representative of a party involved in the accident;
(3) a licensed insurance agent of a party involved in the accident;
(4) an insurance carrier using the accident report for an insurance-related purpose;
(5) a person or entity under contract with the insurer to provide claims or underwriting information, including an insurance support organization;
(6) a licensed private investigator;
(7) an attorney or the attorney's representative; and
(8) any local, state or federal agency that is
authorized by law to have access to accident reports."".,
and thence referred to the TRANSPORTATION AND PUBLIC WORKS COMMITTEE.
