AN ACT

RELATING TO GOVERNMENTAL CONDUCT; PROHIBITING CERTAIN OFFICIALS FROM ACCEPTING PAYMENT FOR LOBBYING OTHER GOVERNMENT OFFICERS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Governmental Conduct Act is enacted to read:

     "[NEW MATERIAL] LEGISLATORS, PUBLIC OFFICERS, COUNTY OFFICERS AND MUNICIPAL OFFICERS--CERTAIN LOBBYING PROHIBITED.--

          A. A legislator, or a public officer, county officer or municipal officer holding elective office, shall not accept compensation for the purposes of lobbying a legislator or a public officer, county officer or municipal officer.

          B. The prohibition on lobbying specified in Subsection A of this section shall not prevent a legislator, or a public officer, county officer or municipal officer holding elective office, from appearing on behalf of and representing the interests of the office to which the legislator or officer was elected or appointed.

          C. For the purposes of this section, "lobbying" means being compensated for attempting to influence a decision on a bill, resolution, rule, ordinance, policy or other type of nonadjudicatory official act on which a legislator, or a public officer, county officer or municipal officer holding elective office, may take action in an official capacity."
