AN ACT

MAKING AN APPROPRIATION FROM THE SMALL COUNTIES ASSISTANCE FUND FOR CURRY COUNTY; DECLARING AN EMERGENCY.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATION.--One hundred forty thousand dollars ($140,000) is appropriated from the small counties assistance fund to the department of finance and administration for expenditure in fiscal year 2010 for distribution to Curry county in lieu of the distribution that would have been made had the county continued to be a qualifying county pursuant to the Small Counties Assistance Act. Any unexpended or unencumbered balance remaining at the end of fiscal year 2010 shall revert to the small counties assistance fund.

     Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
