AN ACT

DELAYING THE APPLICABILITY OF CHANGES TO THE SCHOOL YEAR AND LENGTH OF SCHOOL DAY PROVISIONS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. Laws 2009, Chapter 276, Section 3 is amended to read:

     "Section 3. APPLICABILITY.--The provisions of this act apply to the [2010-2011] 2011-2012 and subsequent school years; provided that the secretary of public education shall certify that sufficient funding has been provided through the state equalization guarantee distribution to provide for one hundred eighty instructional days without eliminating professional development days for licensed school employees."
