AN ACT

RELATING TO PUBLIC SCHOOLS; PROVIDING FLEXIBILITY TO SCHOOL DISTRICTS TO MEET STATE FISCAL SOLVENCY REQUIREMENTS; DECLARING AN EMERGENCY.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Public School Code is enacted to read:

     "[NEW MATERIAL] WAIVER OF REQUIREMENTS--TEMPORARY PROVISION.--The legislature finds that school districts need flexibility to meet state fiscal solvency requirements. For the 2009-2010 through 2011-2012 school years, the secretary may waive requirements of the Public School Code and rules promulgated in accordance with that code upon the request of the local superintendent, after consultation with the local school board. The department shall monitor such waivers, and the secretary shall report to the legislative education study committee and the legislative finance committee on any issues or actions of a school district that appear to adversely affect student learning."

     Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
