Mr. Speaker:

    Your APPROPRIATIONS AND FINANCE COMMITTEE, to whom has been referred

HOUSE BILL 128

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. On page 1, line 13, strike "REDISTRIBUTION" and insert in lieu thereof "AN ADDITIONAL DISTRIBUTION".

     2. On page 1, line 14, strike "IN" and insert in lieu thereof "TO".

     3. On page 2, lines 4 and 5, remove the brackets and line-through.

     4. On page 2, line 24, after "fund" insert the following:

", provided that, in a county with a metropolitan court:

                (1) except as provided in Paragraph (2) of this subsection, the county shall be eligible for a payment in an amount equal to costs and fees collected pursuant to offenses committed within the boundaries of the unincorporated areas of the county, and a municipality in that county shall be eligible for a payment in an amount equal to the costs collected pursuant to offenses committed within the boundaries of the municipality; and

                (2) all costs collected pursuant to Subsection B of Section 66-8-116.3 NMSA 1978 shall be paid to the county.".
