AN ACT

RELATING TO PUBLIC SCHOOL FINANCE; REQUIRING SCHOOL DISTRICTS TO DEVELOP AND MAINTAIN SCHOOL-BASED BUDGETS; REQUIRING EACH PUBLIC SCHOOL TO PUBLISH ITS BUDGET ON ITS PUBLICLY ACCESSIBLE WEB SITE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. Section 22-8-7.1 NMSA 1978 (being Laws 1993, Chapter 224, Section 1) is amended to read:

     "22-8-7.1. [CERTAIN] SCHOOL DISTRICT BUDGETS SCHOOL-BASED--PUBLICATION ON WEB SITE.--

          A. The local school board [of a school district with a total MEM of greater than thirty thousand] shall develop a school-based budgeting plan for all public schools in the district [for presentation to the legislative education study committee by October 15, 1993]. The plan shall describe the means by which teachers, parents and administrators [will] participate in the development of school-based budgets.

          B. [In those] Each individual public school [districts with a total MEM of greater than thirty thousand, each individual school may voluntarily] shall submit to the local school board a school-based budget based upon the projected total MEM at that school and the projected number of program units generated by students at that school. [If an individual school submits such a budget, the local school board may include it in the budget submission to the department required pursuant to the Public School Finance Act.] The local school board shall develop the school district budget from the budgets submitted by the schools.

          C. Within ten days of the department's approval of the school district's operating budget, each public school shall publish its school-based budget on its publicly accessible school web site."

     Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2011.
